Welcome to GeneWise Coaching (“GeneWise,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website and the coaching, analysis, and educational services we provide (the “Services”). By accessing our website, signing up for the waitlist, or purchasing any Service, you agree to these Terms. If you do not agree, please do not use the Services.
1. Who We Are and What We Offer
GeneWise Coaching is a personalized nutrigenomics coaching service operated by GeneWise LLC, based in the Baltimore–Washington, DC area. Our Services include genetic insights reports, one-on-one and group coaching, educational content, and related materials. The specific deliverables and pricing for each service tier are described on our website and in the service agreement you receive at sign-up.
2. Not Medical Advice
This is the most important thing to understand before working with us. GeneWise provides coaching and education, not medical care. We are not physicians, and we do not diagnose, treat, cure, or prevent any disease or medical condition. Our reports and coaching are based on genetic markers and published research and are intended for general wellness and educational purposes only.
Genetics inform; they do not determine. Our analysis describes tendencies and probabilities, not certainties or diagnoses. Nothing in our Services should be interpreted as a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or a qualified healthcare provider before making changes to your diet, exercise, supplement, or medication routine, and never disregard or delay seeking medical advice because of something in a GeneWise report or session. If you are experiencing a medical emergency, call 911 or your local emergency number.
3. Eligibility
You must be at least 18 years old to purchase or use the Services. By using the Services, you represent that you are 18 or older and that any information you provide is accurate and belongs to you (or that you are legally authorized to provide it).
4. Genetic Data and Analysis
Our analysis relies on genetic data that you either (a) provide by uploading raw data from a third-party testing service (such as 23andMe, AncestryDNA, or Sequencing.com), or (b) generate through a DNA test kit arranged through our testing partner. You are responsible for ensuring that any data you upload is your own and that you have the right to share it. The accuracy of our analysis depends on the accuracy and completeness of the data you provide. We are not responsible for errors originating in third-party testing data.
5. Payment, Pricing, and Cancellations
Prices for each service tier are listed on our website and may change at any time; the price in effect at the time of your purchase applies to that purchase. Payment is processed securely through Stripe. A deposit or full payment is required to begin work.
Cancellations and refunds: Because each engagement involves custom analysis and preparation, the following applies:
- Sessions may be rescheduled with at least 24 hours’ notice. Sessions cancelled with less notice, or missed without notice, may be forfeited.
- Once we have begun genetic analysis or delivered a report, fees for that work are non-refundable, as the work product cannot be returned.
- If you cancel before any analysis has begun, you may be eligible for a refund less any non-refundable third-party costs (such as a DNA test kit already ordered).
The full cancellation and refund terms are set out in your service agreement, which controls if there is any conflict with this summary.
6. Your Responsibilities
To get value from the Services and for them to be safe, you agree to provide accurate and complete health and lifestyle information, to disclose relevant medical conditions and medications, and to consult your healthcare provider before acting on recommendations. You are responsible for your own health decisions and outcomes.
7. No Guarantee of Results
Wellness outcomes depend on many factors outside our control, including your individual biology, consistency, and circumstances. We do not guarantee any specific result, health outcome, or level of improvement. Examples, testimonials, or sample reports are illustrative and not promises of your results.
8. Intellectual Property
The GeneWise name, logo, methodology (including the GeneWise Method™ and associated frameworks), report templates, analysis tools, educational content, and all materials we provide are the property of GeneWise Coaching and are protected by intellectual property laws. When you purchase a Service, we grant you a personal, non-transferable license to use the report and materials we deliver for your own personal use. You may not copy, resell, redistribute, or use our materials to build a competing service.
9. Third-Party Services
We rely on trusted third parties to deliver the Services, including Practice Better (practice management), Stripe (payments), our DNA testing partner, and third-party data sources you choose to use. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the acts, omissions, or policies of third parties.
10. Insurance
GeneWise Coaching carries professional liability insurance. This insurance does not alter the nature of our Services or these Terms, including the limitations of liability below.
11. Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, GeneWise Coaching and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the Services. To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid us for the Service giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Baltimore County, Maryland, and you consent to that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated where practical. Your continued use of the Services after changes take effect means you accept the updated Terms.
